By accessing and using PattrIQ ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

PattrIQ is a social content intelligence platform that helps users analyze social media posts, detect content patterns, and generate platform-native content plans for X (Twitter) and LinkedIn. The Service provides features including AI-powered pattern detection, strategy generation, idea generation, content planning, and draft creation.

By using PattrIQ, you agree to comply with the Terms of Service of any platform whose data you import or analyze (including X (Twitter) and LinkedIn). The Service operates as a tool to help you understand and plan content based on data you are authorized to use. You must not import data in violation of any platform's terms or applicable law.

You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You must be at least 16 years old, or meet the minimum age in your jurisdiction with required parental or guardian consent where applicable, to use this Service.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code or content
• Use the Service to harass, abuse, or harm others
• Resell or redistribute the Service without permission
• Import data you are not authorized to use or analyze

The Service and its original content, features, and functionality are owned by Sjenkie B.V. and are protected by international copyright, trademark, and other intellectual property laws. PattrIQ, its branding, and all associated AI-generated outputs produced by the Service are the property of Sjenkie B.V.

You retain ownership of any content you import or create within the Service. By using the Service, you grant us a license to store and process your content solely for the purpose of providing the Service to you. We do not use your content to train AI models or share it with third parties beyond what is necessary to deliver the Service.

PattrIQ uses AI models to generate strategy summaries, content ideas, plans, post drafts, and images. These outputs are provided as suggestions only. You are solely responsible for reviewing, editing, and taking responsibility for any content - including AI-generated images - that you publish based on AI-generated outputs. Sjenkie B.V. makes no guarantees regarding the accuracy, appropriateness, originality, or performance of AI-generated content.

AI-generated images are produced by third-party models (currently Replicate) and stored on your behalf. You are responsible for ensuring that any images you publish comply with applicable laws, platform terms, and intellectual property rights. Sjenkie B.V. does not claim ownership of AI-generated images produced for your use.

PattrIQ integrates with third-party services including AI model providers via OpenRouter, image generation via Replicate, media storage via DigitalOcean Spaces, and social media platforms via their official APIs (such as X/Twitter). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or conduct of third-party services.

When you connect a third-party account (such as X/Twitter or LinkedIn) via OAuth, you authorize PattrIQ to access your account data as described in the consent flow. This may include reading your public posts and engagement metrics, and scheduling and publishing content on your behalf. You may disconnect your account at any time from your Account settings. Disconnecting immediately revokes our access and deletes your stored tokens.

You remain solely responsible for any content published to third-party platforms through the Service, including compliance with that platform's terms.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

We employ industry-standard security measures to protect your data, including:

• TLS encryption for all data in transit
• AES-256-GCM encryption for third-party OAuth tokens at rest
• Secure, passwordless email authentication
• HttpOnly session cookies (not accessible to JavaScript)
• Rate limiting to prevent abuse

While we implement robust security measures, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security but are committed to protecting your data using best practices.

Some service providers we rely on may process data outside your country. Where required by applicable law, we rely on contractual and organizational safeguards (such as Standard Contractual Clauses or equivalent mechanisms) for cross-border transfers.

To the maximum extent permitted by law, Sjenkie B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including any losses arising from content you publish based on AI-generated outputs.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
